These Terms of Service ("Terms") govern your use of the Flixpickr mobile application and the website at flixpickr.app (together, the "Service"), provided by Seedow Studio SRL ("Seedow Studio", "we", "us"), a limited liability company registered in Romania (EU). Please read them carefully.
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Flixpickr provides personalized movie and TV recommendations, ratings, your "Viewer DNA" personality profile, collaborative Groups and Shared Lists with voting, user-authored Collections that can be published publicly and that other users can react to, and an optional paid "Pro" subscription. We may add, change, or remove features over time.
You must be at least 16 years old to use the Service. By using the Service, you confirm that you meet this requirement.
You are responsible for the activity under your account and for keeping your credentials secure. When using the Service, you agree not to:
The "Pro" plan is an auto-renewing subscription billed through your Apple App Store or Google Play account, managed on our behalf via RevenueCat. Your subscription renews automatically at the end of each billing period unless you cancel beforehand. You manage renewal and cancellation in your App Store or Google Play account settings; deleting the app does not cancel a subscription.
If you are an EU consumer, you may have a statutory right of withdrawal for digital purchases; note that this right may be lost once digital content or a service is supplied with your prior express consent and acknowledgment. Nothing in these Terms limits any mandatory statutory consumer rights you have under applicable consumer-protection law.
You retain ownership of the content you create, including Collections, lists, and reactions ("User Content"). By submitting User Content, you grant Seedow Studio a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content as needed to operate and promote the Service. For Collections you publish publicly, this license extends to displaying them — along with your display name and profile photo — in the public discovery feed and on public web pages at flixpickr.app.
You are solely responsible for your User Content and confirm you have the rights necessary to submit it. You may unpublish or delete your Collections at any time. We may remove or restrict User Content that violates these Terms, infringes others' rights, or is otherwise unlawful, and we respond to valid intellectual-property and takedown requests sent to privacy@seedowstudio.com.
We may suspend or terminate your account, with or without notice, if you:
You may stop using the Service and delete your account at any time. On termination, your right to use the Service ends; public Collections and other shared content may be removed, and provisions that by their nature should survive (including ownership, disclaimers, and limitation of liability) will continue to apply.
The Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. Movie and TV data is provided by TMDB and the OMDb API and may be inaccurate, incomplete, or out of date. This product uses the TMDB API but is not endorsed or certified by TMDB. Recommendations and Viewer DNA results are generated automatically and are not guaranteed to be accurate or suitable for any purpose.
To the maximum extent permitted by applicable law, Seedow Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising from your use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, and your mandatory rights as a consumer under applicable law are not affected.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you within the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the European Union and of the EU member state in which Seedow Studio is established, without prejudice to any mandatory consumer-protection rules of your country of residence. For any questions about these Terms, contact privacy@seedowstudio.com.
